Insurance Fund Contests Board Decision
In an application filed with the supreme court this morning by the Globe Insurance Company of Utah, for a writ of review, a new angle in regards to workman's compensation is presented and the court will be asked to pass upon the question which is involved.
The industrial commission is the administrator of the state insurance fund and it also acts in an administrative capacity in awarding compensation payable from the fund. The question presented is as whether it can act in both capacities.
In the case at issue.. Roy S. Porter, who was a supervisor of Salt Lake county, while at work on the highway August 17, 1919, it is alleged suffered injury which resulted in his death. His sidow, for herself and as guardian, applied for and was awarded compensation under the workman's compensation law by a majority decision. The award was $13.85 per week for a period not to exceed 312 weeks, or a total compensation of $4321.
Commissioner W.P. Monson dissented from the majority decision, holding that Porter died from natural causes and not as a result of an accident.
The state insurance fund contested the award and petioned for a rehearing, which was denied." Salt Lake Telegram, August 18, 1920.

Gerald and his older brother, Lawrence, helped their father build their home in Buena Vista, Utah.
In 1916 Gerry joined the U.S, army. He trained at Camp Dix, New Jersey and then patrolled the border at Douglas, Arizona. During World War I, on April 24, 1918, he was shipped to France with the 5th Division. He was wounded in the arm at St. Mahiel Sector of September 28, 1918 and returned to the U.S. on January 30, 1919. He was in recruiting service at Camp Dix before returning to Salt lake City.
Gerry then went to Los Angeles, California where he married Ghewndolyn Hughes Cannon, in 1922. They had one son, Gerald Churcuhill Quick Jr. who was born in 1924.
Gerry worked for his brother-inlaw, James, at Cannon Electric Development Co. when it was just beginning.
Ghewn died of what was called "quick consumption" contracted when she participated as an "extra" in a mothion picture. She was only twenty-eight years old and her son was only four and a half.
